济南发出全市首份家庭教育指导令
因与医院发生纠纷，一女子在医院生下一女孩后，将婴儿留在重症监护室一年多不肯领回。针对此案，济南市槐荫区人民法院发出了全市首份家庭教育指导令，依法督促和引导失职监护人正确履行监护职责。
自2022年1月1日《中华人民共和国家庭教育促进法》正式施行后，家庭教育从“家事”上升到“国事”，由此产生的新概念“依法带娃”也引发了社会众多热议。
2021年1月1日，陈某在某中医院生下一女小花，后转院至济南某医院。因与济南某医院发生纠纷，陈某拒绝为小花办理出院手续，拒绝接小花出院。小花只能一直生活在该医院新生儿重症监护室，至今已经一年有余，其间由医院医护人员看护。无奈之下，该医院将陈某诉至槐荫区法院，要求判令陈某为小花办理出院手续。
槐荫区人民法院审查后认为，作为未成年人的父母应当依法履行监护职责，为未成年人提供生活、健康、安全等方面的保障，关注未成年人的生理、心理状况和情感需求;小花现处于最需要母亲关心爱护的阶段，陈某作为其母亲应积极履行监护责任，不能因为有纠纷存在就对小花放任不管，致使小花长时间脱离母亲的看护，享受不到应有的母爱;而且随着小花的成长，她也需要在良好的家庭环境中接受家庭教育，以促进身心健康发展。
槐荫区法院依照《中华人民共和国未成年人保护法》《中华人民共和国家庭教育促进法》的相关规定，依法向陈某发出家庭教育指导令，责令陈某依法履行监护责任，尽到监护义务，让小花得到母亲的关爱，接受与其年龄相适应的家庭教育，促进身心健康成长;如违反法定义务，怠于履行监护职责，将依法给予教育、训诫等惩戒措施，构成犯罪的，依法追究刑事责任。
每个孩子的成长只有一次，父母双方监护人的责任不可或缺。解决“不依法带娃”问题已不再是简单的“家务事”，而是应纳入法律规制范围内的，需要全社会共同努力的重要议题。
